The D.C. Circuit Court of Appeals has ruled in favor of supporters of the healthcare reform law. In a 2-1 decision, the court found that the individual mandate provision of the Affordable Care Act (ACA) is constitutional.
Tuesday’s decision upholds a lower court ruling that determined that the individual mandate provision of the ACA, which requires everyone to have insurance by 2014 or else pay a penalty, is in line with the U.S. Constitution.
The plaintiffs in D.C. case are five individuals who say they can afford to purchase health insurance, but choose not to. If they have to seek medical care in the future, they’d prefer to pay for the services out-of-pocket, according to the brief. Read More
